These Author Terms define the rules for publishing and licensing literary works (hereinafter: “Works”) by Authors in the mobile app and website operating under the serio.fm brand (hereinafter: “Platform”). The Platform operator is Adrian Górny, residing at ul. Lema 2c, 80-126 Gdańsk (hereinafter: “Operator”). An Author is any person who has created a creator account on the Platform and posted their Work on it.
By uploading a Work to the Platform, the Author declares that they hold exclusive and unrestricted economic copyright to the Work and that the Work does not infringe the rights of third parties. Posting a Work on the Platform does not transfer economic copyright to the Operator. The Author remains the owner of their work and may publish it (including commercially) in any other place, publishing house, or platform.
Upon uploading a Work to the Platform's servers, the Author grants the Operator a royalty-free, non-exclusive, territorially unlimited licence for the duration of the account on the Platform. The licence covers entering the Work into the memory of computers, servers, and telecommunications networks (hosting) and making the Work publicly available so that anyone may access it at a place and time of their choosing via the Platform. Derivative rights (AI Audio): The Author expressly consents to the Operator creating adaptations of the Work. An adaptation consists solely of the automated conversion of text into an audio layer (Text-to-Speech) using artificial intelligence (AI) and making that layer available within the Platform under the royalty-free licence. Marketing: The Author permits the Operator to use short fragments of the Work to promote the Platform on social media and the internet.
The Platform currently makes content available to users entirely free of charge. Accordingly, the Author acknowledges and consents that the granted licence is entirely royalty-free, and the Author is not entitled to any remuneration or financial claims for publishing the Work on the Platform. The Operator plans to introduce monetization features in the future. When paid options launch, the Operator will present the Author with new terms containing revenue-share rules, and further publication and monetization will require acceptance of the new terms.
The Operator has the right to immediately remove a Work and block the Author's account when the Work infringes third-party copyright (plagiarism) or violates Apple App Store or Google Play guidelines (including hate speech, graphic violence, hardcore pornography). Platform users can report infringing content using the application's built-in mechanisms.
The Author may at any time request removal of their Works from the Platform or remove them themselves using the options in their account. Removal of a Work is equivalent to terminating the licence, and the Operator permanently removes the text and generated audio files from active public servers without undue delay. Matters not regulated herein are governed by Polish law, including the Act on Copyright and Related Rights.
